CHUBBUCK A local man who reportedly engaged in lewd behavior with the 13-year-old victim was arrested after a victim’s friend reported the incident to an adult.
The 35-year-old Weston Tyler Smith was accused with four felonies related to indecent behavior with a minor.
He could spend up to life behind bars if found guilty.
Smith’s preliminary hearing before Magistrate Judge Scott Axline is set for August 5 at 1:15 p.m.
Court filings state that the woman told a friend that Smith had abused her and urged the friend to keep the information private.
A family member was informed by the buddy, and on June 24, they contacted the Chubbuck Police Department to report the occurrence.
According to the complaint, Smith got a drink and offered it to the victim when the victim returned to the hot tub following the initial incident of abuse.
The victim said that after getting intoxicated, Smith had followed her to her room and sexually assaulted her.
The victim claimed that although she was anxious and didn’t want to disturb her family, she wanted to notify them the next day.
She remembered that the other night, Smith had visited the living room and asked the victim whether she remembered, to which she replied that she didn’t. According to the victim, Smith informed her that everything was good and that he didn’t recall because he had been intoxicated.
A CPD investigator and Child Protective Services came to the house and talked to the victim about what had happened. She said “yes” when asked if she had ever been touched inappropriately.
Because of Smith’s inappropriate contact, the victim had a forensic interview at the Bright Tomorrow Advocacy Center on June 26.
According to the documents, the victim said that Smith had repeatedly touched her sexually from April until a few weeks prior to the interview date.
She claimed that Smith had done this to teach her about sex and puberty.
The victim claimed that while both of them were nude, Smith would describe various bodily regions. Among the events, she claimed, Smith asked her to assist in relieving him.
Smith may not have committed these offenses, even if he has been charged with them. Until someone is proven guilty, they are all presumed innocent.
